What is a Montana Bill of Sale?

In the state of Montana, proving ownership of a vehicle is one of the main things to consider when purchasing or selling any vehicle one of the ways to document vehicular ownership is by completing a bill of sale. The motor vehicle bill of sale, considered a legal document, will outline the information necessary to prove that ownership has transferred from the seller of the vehicle to the purchaser of the vehicle.

The bill of sale is also necessary in most states for the new owner to obtain a registration in their name, a new Certificate of Title, or insurance. The document serves as a receipt for the purchaser as well. Various states may require the DMV bill of sale in order to calculate the appropriate amount of sales tax on the vehicle.

Is a Motor Vehicle Bill of Sale Necessary for MT?

The state of Montana does require a vehicle purchaser to provide a motor vehicle bill of sale in order to obtain a new Certificate of Title, registration and tag. Generic bill of sale forms can be found online or created, however some states have specific guidelines for the information that must be included on each document. Montana, for instance, has a state-approved DMV bill of sale available for download.

As a purchaser or a seller, information that should appear on the motor vehicle bill of sale includes:

  • The name and address of the seller and the purchaser
  • Amount paid to the seller
  • Accurate odometer reading
  • Vehicle Identification Number (VIN)
  • Make, model, year, series number, body type
  • Date of sale
  • Seller and purchaser signatures

It is also a good idea to have the bill of sale notarized to confirm the dates and signatures on the document.
